By accessing or using Trade Noted ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Service. The Service is operated by S and A Marketing FZ-LLC.

2. Description of Service

Trade Noted is a free trading journal platform that provides manual trade logging, CSV import, performance analytics, rules enforcement, Monte Carlo simulation, and optional public portfolio sharing. The Service does not connect to brokers, execute trades, or provide financial advice.

3. Account Registration

• You must provide a valid email address to create an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the Service
• One person may maintain only one account
• You must provide accurate information and keep it updated

4. User Responsibilities

• You are solely responsible for the accuracy of trade data you enter
• You are responsible for your trading decisions and outcomes
• You must not use the Service for any illegal purpose
• You must not attempt to gain unauthorized access to the Service
• You must not interfere with or disrupt the Service
• You must not scrape, crawl, or automated access the Service without permission

5. Trading Data

You retain ownership of all trade data you enter into the Service. We do not claim any intellectual property rights over your trading data. You grant us a limited license to process your data solely for the purpose of providing the Service.

6. Public Portfolio Sharing

If you enable public portfolio sharing, you acknowledge that selected data will be publicly accessible. You are responsible for reviewing your privacy settings before sharing. Public portfolio data is provided as self-reported information and is not independently verified by Trade Noted.

7. No Financial Advice

Trade Noted is a journaling and analytics tool. It does not provide financial advice, investment recommendations, or trading signals. All analytics, metrics, and simulations are for informational and educational purposes only. You should consult a qualified financial advisor before making trading decisions.

8. Risk Disclaimer

Trading financial instruments involves substantial risk of loss and is not suitable for every investor. Past performance, whether actual or simulated, is not indicative of future results. The use of Trade Noted does not guarantee trading success or reduce trading risk.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any losses resulting from service downtime.

10. Intellectual Property

The Trade Noted name, logo, design, and all associated intellectual property belong to S and A Marketing FZ-LLC. You may not use our trademarks without prior written permission. The Service code, design, and documentation are proprietary.

11. Limitation of Liability

To the maximum extent permitted by law, Trade Noted and S and A Marketing FZ-LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to trading losses, data loss, or loss of profits.

12. Account Termination

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes. Continued use of the Service after changes constitutes acceptance of the modified terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation before pursuing legal remedies.
